1. Acceptance of Terms
By accessing or using Lateral ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.
2. Description of Service
Lateral is a Zoom App that provides bilateral stimulation tooling for use by licensed mental health professionals during telehealth sessions. The Service is intended for professional use only.
3. Eligibility
You must be a licensed mental health professional operating within the laws and regulations of your jurisdiction to purchase a seat and use the therapist controls. Clients joining a session as Zoom participants are not required to create an account.
4. Accounts and Seats
Each purchased seat is licensed to a single therapist email address and may not be shared, transferred, or resold. You are responsible for maintaining the confidentiality of your account credentials.
5. Subscriptions and Billing
Seats are billed on a monthly recurring basis via Stripe. You may cancel at any time; access continues through the end of the current billing period and no partial-month refunds are issued. Prices may change with 30 days' notice.
6. Acceptable Use
You agree not to use the Service for any unlawful purpose, to reverse-engineer or attempt to extract source code, to interfere with the availability of the Service, or to use it in a way that violates any professional ethical obligations or applicable law.
7. No Clinical Advice
Lateral provides a software tool only. It does not provide medical, psychological, or clinical advice. The therapist is solely responsible for all clinical decisions and the appropriateness of EMDR treatment for any individual client.
8. Data and Privacy
We do not record, store, or transmit any session content, video, or audio. See our Privacy Policy for details on what data we do collect.
9. Disclaimers and Limitation of Liability
The Service is provided "as is" without warranty of any kind. To the maximum extent permitted by law, Lateral shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.
10. Termination
We reserve the right to suspend or terminate access to the Service at any time for violation of these Terms, with or without notice.
11. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict-of-law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Washington State, and you consent to personal jurisdiction in those courts.
